Terms & Conditions of Sale

Preamble

These terms and conditions of sale (hereinafter the "T&Cs") govern every order placed by a customer (hereinafter the "Customer") with MortierBière (hereinafter the "Seller") on the website www.mortierbiere.fr. Placing an order implies full and unreserved acceptance of these T&Cs. The Seller reserves the right to amend the T&Cs at any time; the applicable T&Cs are those in force on the date the order is confirmed.

1. Seller

MortierBière is a micro-enterprise operating in France. Full details (company name, SIRET number, address, email) appear in the legal notice. Contact: contact@mortierbiere.fr.

2. Product

The product offered is the Mortier à Bière, a rocket-shaped bottle opener made of reinforced ABS, sold at €34.99 incl. tax per unit (VAT not applicable, Article 293 B of the French Tax Code). Delivery is included within mainland France. The Seller endeavours to present the product's characteristics (material, dimensions, weight, operation) as accurately as possible. Slight cosmetic variations may nonetheless occur from one production run to another without constituting a defect.

3. Ordering

Orders are placed online, via the website interface. The Customer is invited to check the contents of their basket, the quantity and the delivery address before final confirmation. Order confirmation, together with an order number, is sent by email to the address provided. The Seller reserves the right to cancel or refuse any order on legitimate grounds (out of stock, suspected fraud, obviously incorrect address).

4. Price and payment

Prices are shown in euros, inclusive of all taxes, excluding delivery charges outside mainland France. Payment is made online via the secure Stripe solution (PCI-DSS Level 1): bank card, Apple Pay, Google Pay or Stripe Link. No banking data is stored by MortierBière. The order is confirmed upon actual receipt of payment. Should payment be declined by the banking institution, the order is cancelled.

5. Delivery

Orders are dispatched from France within 48 working hours of payment confirmation. Transit time varies by destination: 2 to 5 working days within mainland France, 5 to 15 days internationally. An email containing the tracking number is sent to the Customer upon dispatch. Transfer of risk occurs when the parcel is actually handed over to the carrier. In the event of an abnormal delay, the Customer must inform the Seller as soon as possible at contact@mortierbiere.fr.

6. Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to give reasons or bear any costs other than those relating to the return.

To exercise this right, the Customer must notify their decision by email to contact@mortierbiere.fr and return the product in its original condition (undamaged, complete, original packaging) to the address provided in reply. The return costs are borne by the Customer (a flat fee of €5, deducted from the refunded amount). Reimbursement is made no later than 14 days after actual receipt of the return, using the same payment method as that used for the order.

7. Legal guarantees

The product benefits from the legal guarantee of conformity (Articles L.217-3 to L.217-17 of the French Consumer Code) for 2 years from delivery of the goods, and from the guarantee against hidden defects(Articles 1641 et seq. of the French Civil Code) for 2 years from discovery of the defect. To invoke these guarantees, the Customer may contact the Seller at contact@mortierbiere.fr.

8. Liability

The product is intended for domestic use to open pressure-capped bottles. Any use not consistent with its intended purpose (as a projectile, dangerous handling, modification of the product) is undertaken at the Customer's own risk and excludes the Seller's liability. It is the Customer's responsibility to use the product sensibly and in compliance with basic safety rules.

9. Force majeure

The Seller cannot be held liable for any delay or non-performance resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code (natural disaster, carrier strike, failure of a subcontractor beyond the Seller's control, etc.). In such cases, timeframes are suspended for the duration of the force majeure event.

10. Personal data

Data collected in connection with the order is processed in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act. Details of the processing, purposes, retention periods and the Customer's rights are set out in the privacy policy.

11. Mediation and disputes

In accordance with Article L.611-1 of the French Consumer Code, in the event of a dispute that cannot be settled amicably, the Customer may use a consumer mediator free of charge. A European online dispute resolution platform is also available: ec.europa.eu/consumers/odr. Failing an amicable agreement, the French courts alone have jurisdiction, in accordance with Article R.631-3 of the French Consumer Code.

12. Governing law

These T&Cs are governed by French law. The language of the contract is French.
